These Terms of Service ("Terms"), together with the information and policies contained in the "Customer Service" pages of the website and any other documents referred to herein, set out the legal terms that apply to your use of the website www.montagethelabel.com, any of its sub-domains, and the other services that we provide (the "Services").

Please read these Terms carefully before using the Services. By using the website or placing an order, you confirm that you have read, understood and accepted these Terms. If you do not agree with these Terms, please do not use the website.

Throughout these Terms, "we", "us" or "our" means MONTAGE THE LABEL S.R.L., and "you" or "your" means the person using the Services. These Terms are available in Romanian and English; we recommend that you save or print a copy for your records, as they may be amended from time to time.

Access to the website is free of charge and is permitted on a temporary basis, for personal and non-commercial use. You must not reproduce, copy or exploit the website or its content for commercial purposes without our prior written consent.

We reserve the right to withdraw, amend or restrict access to the website, in whole or in part, without prior notice, and we will not be liable for any unavailability of the website.

You agree to use the website only for lawful purposes and not in any way that could damage, overburden or impair the website or the access of other users to it, including by transmitting unlawful, offensive, defamatory, fraudulent content, content that infringes intellectual property or privacy rights, computer viruses, or unsolicited messages (spam).

Any breach of these provisions may constitute a criminal offence or misdemeanour under applicable Romanian and EU law; we will cooperate with the competent authorities and disclose the identity of any person responsible for such a breach, to the extent permitted by law.

4. Limitation of Liability

The content of the website is provided for general information purposes only and may be updated or amended without prior notice. We make reasonable efforts to ensure the accuracy of the information published, but we make no express or implied warranties as to its accuracy, completeness or currency.

We will not be liable for losses or damages that are not a reasonably foreseeable consequence of our breach of these Terms or of our negligence. We do not in any way exclude or limit our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) any other liability which cannot be limited by law.

As a consumer, you have legal rights under applicable consumer protection legislation in relation to defective or misdescribed products; these Terms do not affect your statutory rights.

5. Orders, Prices and Payment

By completing the checkout process and clicking the "Place order" button, you make an offer to purchase the products in your shopping cart. The contract is deemed concluded between you and MONTAGE THE LABEL upon your receipt of the order confirmation, sent electronically (e-mail and/or SMS).

To place an order, you must be at least 18 years old, provide true and complete information, and hold a valid means of payment with sufficient funds to cover the order.

The order confirmation e-mail is for information purposes only and does not constitute our acceptance of the order; the contract is only deemed complete once payment for the order has been verified as received. The subsequent shipping confirmation constitutes evidence that the contract has been concluded and includes a description of the products ordered, delivery details, and information about your right of withdrawal.

Although we make reasonable efforts to ensure the accuracy of prices and product descriptions displayed, occasional errors may occur. If we discover a pricing or availability error after your order has been placed, we will inform you and give you the option to confirm the order at the correct price or cancel it; if we are unable to contact you, the order will be treated as cancelled and any amounts paid will be refunded in full.

Prices for products sold within Romania are expressed in RON and include VAT. For deliveries outside Romania, prices are expressed in EUR and/or USD and may not include VAT. Accepted payment methods include online card payment (Visa, Visa Electron, Mastercard, American Express), Revolut, PayPal, and cash on delivery for orders up to RON 1,000.

Customs duties and charges applicable to deliveries outside the European Union are not included in the price and are the responsibility of the recipient of the order, in accordance with the customs regulations of the destination country.

We reserve the right to refuse or cancel an order, for example where the ordered product is out of stock; in such a case, any amounts paid will be refunded in full.

6. Delivery

Full details of our delivery arrangements are set out in our Shipping Policy, which forms an integral part of these Terms. Delivery times may vary depending on product availability and the delivery address chosen.

If you place an order for international delivery, it may be subject to import duties and taxes payable when the parcel reaches its destination; you are responsible for complying with the laws applicable in the destination country.

7. Right of Withdrawal and Returns

Details of your right to withdraw from the contract, the conditions for returns, excluded products and the refund process are set out in our Return and Refund Policy, which forms an integral part of these Terms.

In summary: except for products expressly excluded (sealed products unsealed for hygiene reasons, made-to-order/custom products), you have the right to cancel the contract within 14 calendar days from the date you receive the products, without needing to give a reason. You can initiate a return directly through the self-serve returns feature available in your customer account or via the "Order status" page.

8. Marketing Communications

You may withdraw your consent to receive marketing communications at any time, either by using the unsubscribe link included in the communications you receive, or by contacting us at office@montagethelabel.com.

We may process data for the purpose of conducting market research and opinion polls, in order to improve our product offering and shopping experience; your answers will not be linked to your identity and will not be shared with third parties for advertising purposes. You may object to this processing at any time using the same contact channels.

9. Protection of Personal Data

We process your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and our Privacy Policy published on the website, which we recommend you review for details of the purposes, legal bases and retention periods of the processing, as well as the rights available to you.

10. Intellectual Property

We are the owner or licensee of all intellectual property rights in the website and its content (text, graphics, logos, images, photographs, data compilations, etc.), protected under Romanian and EU copyright and related rights legislation. All such rights are reserved.

You must not systematically extract or reuse content from the website, including through automated data-extraction tools, without our prior written consent.

11. Governing Law and Jurisdiction

This contract, and any dispute arising out of it or out of your use of the website, is governed by Romanian law. The courts of Romania have exclusive jurisdiction over any disputes or claims relating to these Terms, without prejudice to the mandatory rights of consumers to bring proceedings before the courts of the EU member state in which they are domiciled.

For the amicable resolution of any dispute, you may contact the Romanian National Authority for Consumer Protection (ANPC), www.anpc.gov.ro, or an alternative dispute resolution (ADR) entity. Please note that the European Online Dispute Resolution (ODR) platform was discontinued as of 20 July 2025, pursuant to Regulation (EU) 2024/3228; the updated list of ADR entities in the Member States is available at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies.

12. Final Provisions

If any provision of these Terms is held by a competent court to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

Our failure to immediately enforce any right under these Terms does not constitute a waiver of that right.

We will not be liable for any failure or delay in performing our obligations where this is caused by events beyond our reasonable control (force majeure), including natural disasters, acts of war or terrorism, strikes, disruption to transport or telecommunications networks, or acts of public authorities. In such circumstances, we will notify you as soon as reasonably possible and propose a new delivery date.
